  1. Representing several industrial power consumers before Rajasthan Electricity Regulatory Commission (RERC) against power distribution companies for determination of additional surcharge for the year 2016 in terms of Electricity Act, 2003.

  2. Representing a major cement manufacturer before CESTAT Ahmedabad in a demand on differential duty on import of Coal (steam coal v. bituminous coal) from Indonesia and South Africa. Duty of Rs. 27 crore is sought to be imposed but has been stayed as the matter has been referred to larger bench at CESTAT Chennai for determination.

  3. Representing an iron-ore mining company based out of Goa in a central excise evasion matter before CESTAT, Mumbai.

  4. Representing Rajasthan University of Health Sciences in several service disputes before RCAT and CAT.

  5. Representing a major jewellery manufacturer before Income Tax Appellate Tribunal (ITAT), Jaipur in an evasion matter arising out of search conducted by the department. 
Advisory

An overview of our work in 2015-16.

Capstone Legal has extensive experience both in advisory as well as dispute resolution. The firm has handled more than 300 cases across various fora in 2015-16. On the advisory side, the firm has undertaken assignments ranging from assistance in setting up of a solar power plant to contract management. 

  1. Represented a ballistic expert involved in Jessica Lal murder case, who was sought to be tried under provisions for perjury by the Delhi High Court. The Supreme Court has set-aside the order of the Delhi High Court directing that a complaint may be lodged. The case has also been reported by the Court as (2016) 4 SCC 571.

  2. Represented several Steel Re-Rolling Mills in a bunch of Special Leave Petitions where Central Excise duty was imposed on the basis of ‘Compound Levy Scheme’. Duty was imposed even on reduced capacity of rolling mills; the duty has been stayed by the Court till further orders.

  3. Represented a hospitality company in an appeal filed against OTS Settlement for a loan of Rs. 98 crore, set aside by Allahabad High Court which was entered between the Hospitality Company and Uttar Pradesh Finance Corporation (UPFC).

  4. Represented a mining company against a SLP filed by State of Rajasthan against order passed by Rajasthan High Court directing the mining company to take possession of a marble mining lease illegally cancelled by the State.

  5. Advising major real estate developers in a petition filed by Greater NOIDA authority in which land acquisition in Shahberi village was set-aside by the Allahabad High Court.

  6. Representing several mining companies in T.N. Godavarman v. Union of India in which the height of Aravalli Hills is being agitated and mining operations has been stopped in hills over 100 m above sea-level.Represented members of Anand Bhawan Co-Operative Society in a criminal case lodged against the office bearers under Section 420, 406 IPC for sale of over 600 plots illegally.
Tribunals
  1. Representing a major conductor manufacturer before Bombay High Court in a matter pertaining to denial of CENVAT credit in terms of Rule 8(b). The appeal has been filed against the demand confirmed by CESTAT, Mumbai.

  2. Representing an iron-ore mining company based out Goa in an appeal filed against order passed by CESTAT in pursuance of an inquiry initiated by DGCEI.

  3. Challenged the constitutional validity of Section 35-F of the Central Excise Act which provides for mandatory pre-deposit for hearing appeals before the Tribunal.

  4. Representing a major pharmaceutical company in a trademark opposition against order passed by Intellectual Property Appellate Board (IPAB) before the Gujarat High Court.   

  5. Representing a major cement manufacturer in a sales tax case before the Rajasthan High Court arising out of Sales Tax Deferment Scheme of State of Rajasthan. The duty in the matter is around Rs. 414 crore.

  6. Representing the erstwhile royal family of Kota in a bunch of revenue cases. The value of property under dispute is around Rs. 300 crore.

  7. Representing Commonwealth Human Rights Initiative (CHRI) in a public interest litigation Suo Moto v. State of Rajasthan & Ors. Related to prison reforms. CHRI is an international NGO run by Maja Daruwala.

  8. Representing the royal family of Diggi in series of cases ranging from revenue suits to tenancy matters before the Rajasthan High Court.

  9. Representing Rajasthan Steel Chamber, an association of more than 50 Iron Furnaces and Steel Rolling Mills in several cases before the Rajasthan High Court, including challenge to constitutional validity of regulations under Electricity Act, 2003.

  10. Represented Jai Drinks, the authorized bottler of PepsiCo in NW India in an income tax appeal involving tax demand on goodwill. The value of appeal is close to Rs. 20 crore.

  11. Representing organizers of Jaipur Literature Festival (Diggi House) in a Public Interest Litigation filed to stop the festival due to security & safety concerns. The petition has been dismissed by the High Court.

  12. Representing a major mining company in cancellation of Coal Block by Ministry of Coal, allotted in district Nagaur. The matter is pending adjudication.

  13. Representing a major cement manufacturer in challenge to amendments to the MMDR Act. The retrospective application of several provisions including contribution to National Mineral Exploration Trust is under challenge.

  14. Represented the CEO and CFO of one of India’s leading E-Commerce company in a petition to quash a FIR lodged against them. The FIR was lodged on a false premise and later quashed by the High Court.

  15. Representing Hindustan Copper Limited in a challenge to arbitration award amounting to Rs. 24 crore. 
  1. Advised India’s leading self-drive car rental company Zoomcar in coming up with strategies to reduce the incidents of non-payment and develop a robust recovery mechanism.

  2. Contract management for one of India’s leading manufacturing company which includes authoring, negotiations, approval and obligations management. Thousands of contracts with employees, vendors, service providers, transporters are under management in consonance with Six Sigma principles.    

  3. Advising a software companies in entering into SLAs with vendors for development of software on the Salesforce platform. The assignment includes drafting & negotiation of contracts which may be enforced across various jurisdictions.

  4. Advising one of India’s leading Zinc manufacturers in solving issues related to EPF, Labour Laws and claims arising out of SICA.

  5. Advising a startup on regulatory aspects related to running of two-wheeler rental service in India. Issues involve compliance with MV Act and several state laws. The company intends to launch operations in 3 states simultaneously.

  6. Advising a pharmaceutical company in fulfilling necessary regulatory requirements for setting up of a manufacturing facility in Uttarakhand. The assignment includes a comprehensive analysis of all regulatory aspects, including local laws.

  7. Advising a real estate company, based out of Hyderabad, in developing a solar power plant in Barmer. It includes negotiations with DISCOMs and RRVPNL. 

  8. Assisted in setting up of a mega-food park in Bundi. The assignment involved real estate due diligence of over 400 hectares of land.

  9. Assisting a hospitality company in conducting due diligence relating to real estate and material contracts of a prospective JV partner.

  10. Advising a group of mining companies in formulating strategies to comply with directions of NGT, Bhopal relating to environment clearance from State Level Committee constituted by MoEF.
